NOTICE IS HEREBY GIVEN that the Town of Atlantic Beach Town Council will meet on Monday, December 21, 2020 at 6:00 pm to review the amendment listed below to the Official Zoning Map of the Town of Atlantic Beach and the Town of Atlantic Beach Coastal Area Management Act (CAMA) Land Use Plan. The meeting will be held in the Boardroom behind Town Hall at 125 W Fort Macon Road, Atlantic Beach, NC. All interested citizens are encouraged to attend.
ZMA-20-01 127/129 New Bern Ave Rezoning
Phil Lewis with Ocean Reef Investments LLC has requested a zoning map amendment (rezoning) 127/129 New Bern Avenue from the Residential Single-family Wide yard (RSW) to the Residential Multi-Family (RMF) zoning district.
Following the public hearing, the Town Council will consider adoption of the amendments to the Official Zoning Map and the Future Land Use map of the Land Use Plan. Once adopted, the amended Land Use Plan will be submitted to the Coastal Resources Commission for certification. This will not affect the current Land Use Plan Update process.
Written objections, comments, or statements of support of the Land Use Plan amendment shall be submitted to the Division of Coastal Management’s District Planner, Rachel Love-Adrick, 400 Commerce Avenue, Morehead City, NC 28557 no less than 30 calendar days after local adoption of the amendment. Copies of the amendments are available for review by the public at Town Hall during normal office hours and on the Town’s website. The public is encouraged to review the amendments and to attend the public hearing.

NOTICE IS HEREBY GIVEN that the Atlantic Beach Town Council and Planning Board will have a joint meeting on December 1, 2020 at 6:00pm. The meeting will be held in the Boardroom behind Town Hall at 125 W Fort Macon Road, Atlantic Beach, NC. The public is invited to attend and participate.
The purpose of the public hearing is to review, discuss, and hear public comment, both oral and written, regarding the following Major Site Plan Concept Proposals:
- MSP-20-1 – Amendment – Crystal View
An amendment to the Crystal View Condominiums major site plan, to change the active open space from shared access of the existing swimming pool to a horseshoe court directly south of the proposed building.
- MSP-20-2 – Amendment – Tackle Box Tavern
An amendment to the Grove Oceanside II Phase II (AKA Tackle Box Tavern) major site plan, to recombine the two commercial parcels to allow the Tackle Box to expand to include a restaurant named “Bait Box”.
- MSP-20-3 – Oceanana Redevelopment
A major site plan for redevelopment of the Oceanana Motel, Pier House, and manufactured home park, to include 17 townhouses, 127 condominium units, pier house, and swimming pool. 125 West Fort Macon Road, the Atlantic Beach Town Council will hold a public
hearing to receive public comment, both written and oral, regarding the Town’s
consideration of an installment financing contract for the improvement of the property
at 125 W Fort Macon Road for construction of a new Public Safety and Town Hall
Complex, as authorized under N.C. General Statute 160A, Article 3, Section 20.

FINAL PUBLIC NOTICE
The Town of Atlantic Beach has applied for Federal Emergency Management Agency (FEMA) Public Assistance (PA) funding through the North Carolina Emergency Management (NCEM) as a sub-recipient.
Under the National Environmental Policy Act (NEPA), federal actions must be reviewed and evaluated for feasible alternatives and for social, economic, historic, environmental, legal, and safety considerations. Under Executive Order (EO) 11988 and EO 11990, FEMA is required to consider alternatives to and to provide a public notice of any proposed actions in or affecting floodplains or wetlands. EO 12898 also requires FEMA to provide the opportunity for public participation in the planning process and to consider potential impacts to minority and low-income populations. This notice may also fulfill requirements under Section 106 of the National Historic Preservation Act (NHPA).
Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state, and local laws, regulations, floodplain standards, permit requirements and conditions.

Special Flood Hazard Area Zone:
This project is for the removal of sand from parking lots, repair of beach furniture and wooden strand crossovers located in VE flood zone (Elevation 11-14 Feet) and a fishing pier (including seawall support) located in AE flood zone (Elevation 7 Feet). Confirmation of location in the floodplain was made by reference to the latest Preliminary Flood Insurance Rate Map, Panel 3720636500K, 3720637500K, 3720638500K, and 3720639500K, dated 06/30/2016. The proposed work conforms to all applicable State of North Carolina and local floodplain regulations. The proposed work will be done on existing structures and will have no effect on the local floodplain. The proposed work has the potential to be impacted by flooding in the future but is functionally dependent on its location in the floodplain. The proposed work will take place in wetlands per the United States Fish and Wildlife Service National Wetlands Inventory and will have little potential to impact or affect wetland values.
Proposed Work and Purpose:
The Town of Atlantic Beach is requesting funds to remove sand from beach front parking lot area (Circle Boardwalk area); repair miscellaneous beach furniture, sand fencing, and two wooden strand walkways. Additionally, the Pelican St. Pier will have repairs to decking and seawall cap board, and replace fill behind seawall. Damaged sand fencing will remain in place for continued dune support. A portion of the project funding will be used to purchase machinery, emergency equipment, and response vehicles to better serve the community and visitors. The purpose of this project is to replace structures and supplies that are in support of open space use encouraging tourism in the Town of Atlantic Beach.
Alternative #1 (no action alternative): If no action is taken to protect these public facilities, it will impact tourism and safety for the Town of Atlantic Beach.
Alternative #2: (Relocation) Relocating structures outside of the SFHA and coastal VE zones was evaluated. The practicability of moving these structures out of the flood zone would defeat their purpose as they are installed to promote open space use and stimulate tourism in the beach and pier areas.
